Great News for Venezuelans!

Venezuelans are now protected by Deferred Enforced Departure (DED) for 18 months. While it is a temporary status, it protects against removal/deportation from the US and allows you to apply for a work permit during that time.

The requirements are:

  • You must be a national of Venezuela, or alien without nationality who last habitually resided in Venezuela,
  • You must be present in the United States as of January 20, 2021
  • It does not apply to those who:
    1. have voluntarily returned to Venezuela or their country of last habitual residence outside the United States;
    2. have not continuously resided in the United States since January 20, 2021;
    3. who have been convicted of any felony or 2 or more misdemeanors committed in the United States, or who have been determined to be a national security risk, or who are subject to extradition.

While we are waiting for final filing instructions from USCIS, meanwhile we can prepare your work permit applications and the necessary documents to demonstrate eligibility. It is important that an attorney analyze your case to make sure that you qualify and that it makes sense in your specific case. Travel permits may be authorized but must wait for instructions before determining whether to apply for a travel permit in your case.

Please note that DED is not permanent. At the end of the 18 months, it can be extended or terminated. If you already have legal status (other than Permanent Resident or US Citizen) it may still be a good idea to apply for a work permit under DED. That decision should be made after speaking to an attorney and fully analyzing your case and your options.
